Image Capture and Publication Policy

In compliance with Regulation (EU) 2016/679 (GDPR), Organic Law 1/1982 of 5 May on the Civil Protection of the Right to Honour, Personal and Family Privacy and Self-Image, and Organic Law 3/2018 (LOPDGDD), we inform you about our policy on the capture and publication of images at Grupo Enjoy venues.

This policy applies to the venues Enjoy Terrace, Outxide Club and Hiru Food & Drinks, all operated by Enjoy Club 78 S.L. and located in Alcudia, Mallorca.

During events, parties and activities at our venues, authorised staff or photographers/videographers hired by Enjoy Club 78 S.L. may take photographs and video recordings of the general event atmosphere.

These images may be used for the following purposes:

• Publication on Grupo Enjoy's official social media accounts and those of its venues (Instagram, TikTok, Facebook).
• Publication on the website www.grupoenjoy.es and its subsections.
• Promotional and advertising material (digital and print).
• Commercial communications and group newsletters.

At the entrance to each venue where image capture takes place, a visible notice will be displayed with at least the following content:

"Notice: This venue captures photographic and video images for promotional purposes. By entering the premises, you accept the possibility of appearing in such images. If you do not wish to be photographed, please inform the staff. You may request the removal of published images at [email protected]."

The capture of general-atmosphere images at the venue is based on the legitimate interest of Enjoy Club 78 S.L. in promoting its services (Art. 6.1.f GDPR), given that:

• The images reflect the general atmosphere and are not focused on specific individuals.
• Prior notice is given through visible signs at the entrances.
• Attendees may express their objection to venue staff.
• There is an accessible procedure for requesting the removal of images.

For individual or close-up images that clearly identify a person, explicit consent will be sought from the individual before publication.

Any person appearing in images published by Grupo Enjoy has the right to request their removal. To do so, you may:

1. Send an email to [email protected] stating:
   • Your full name.
   • A link to or description of the image/post in question.
   • A reference photo or indication to identify you in the image.
2. Communicate this in person to the venue staff during the event, who will take note and forward the request.

We commit to processing removal requests within a maximum of 72 business hours from receipt, removing the image from our social media and website. We cannot guarantee the removal of copies made by third parties before the takedown.

Our venues have CCTV surveillance systems for security purposes, duly signposted in accordance with current regulations. Security recordings:

• Are retained for a maximum of 30 days, unless required by a court or police order.
• Are not used for promotional purposes and are not published in any medium.
• Access is restricted to authorised security personnel.

We do not intentionally publish images of minors. If a published image is found to include a minor, it will be removed immediately upon identification or at the request of their legal guardian.
